General Terms and Conditions
The usual minimum age is 8 for Sailing or Windsurfing and 15 for Powerboating Certification; however, in consultation with the Principle this may be reduced.
A deposit of 1/3 of the Full Payment must be received along with the booking form to confirm your booking if making your booking 8 weeks or more from your course start date.
If you are making your booking less than 8 weeks from your course start date, Full payment is required to confirm your booking.
CANCELLATIONS
Made up to 8 Weeks before your course start date will forfeit DEPOSITS only.
Made less than 8 Weeks prior to your course start date will forfeit 100% of the total booking cost, UNLESS another student is booked to take your place.
All prices include GST, receipts are available upon request.
Elements Watersports reserves the right to cancel a course or to request that a student withdraws from the course if safety of others is in any doubt.
Elements Watersports reserves the right to alter the course to suit conditions and the needs of the group, making every effort to deliver the booked activity.

The Balance of your payment is required 4 weeks prior to the first course date. Courses are not confirmed unless full payment has been received.
Bookings made within 4 weeks of your course start date require Full payment before your booking is confirmed.
Groups are to provide a spreadsheet of students attending the course along with any medical conditions prior to joining us.

RENTAL OF EQUIPMENT
Is subject to Elements Watersports conditions of rental, the rental staff reserve the right to change or cancel rental activity. Senior Staff should be made aware of any Issues arising on the day so that a positive outcome can be arranged.
Safety Terms and Customer Declaration
In any adventure activity, there is an element of risk involved. Risks in undertaking this activity include injury, illness/ death from drowning, exposure or accident. Risk of loss/ damage to personal property. Full details of the risks involved and their management is available on request.
The staff and management at Elements Watersports© take all practicable steps to identify and minimise potential dangers. However, you must follow our instructions and use the safety equipment provided at all times.
Adults accompanying any person under the age of 18 must ensure that the underage person follows our instructions at all times.
You must release or indemnify Elements Watersports and our staff against any liability we incur to anyone else, resulting from your failure to follow our instructions or any person accompanying you under the age of 18 to follow our instructions.
We reserve the right to withdraw any person who in our opinion is likely to endanger themselves or others. We also reserve the right to cancel the planned activity if we become concerned for any reason for your safety or that of any other person.
WARNING: Under New Zealand law it is extremely unlikely that you will be able to sue anyone if you are injured. In addition, New Zealand's accident compensation scheme provides only limited assistance to visitors to New Zealand who are injured. We strongly recommend that all visitors to New Zealand have full insurance covering any injury they might suffer, including medical treatment cover before undertaking this activity.
EXCLUSIONS: To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.
Please list on the booking form any medical conditions or other information we need to know to include you safely in this activity. For example: asthma, allergies, heart condition, epilepsy, pregnancy or eye sight restrictions. You are entitled to access any information we hold about you or to request its correction at any time.
